- AI Business Automation: Smart dispatch automation, automated invoicing and billing, driver performance analytics, and fleet management AI.
- Back Office AI: Document processing AI, ELD integration and reporting, safety score monitoring, and automated record keeping.
- Full Package Solutions: Integrated website design combined with business automation services.
All AI automation services are delivered upon audit of your specific business operations and workflows.
3. Eligibility
Our services are available to business owners, operators, and authorized representatives of trucking companies and small businesses. By using our services, you represent that you have the legal authority to bind the entity you represent to these terms.
4. Pricing and Payment
- Project fees start at a flat rate of $1,200, as outlined in individual service proposals.
- Monthly retainer services are available at $400 per month.
- Specific pricing will be detailed in a written proposal or statement of work (SOW) provided to you before any work begins.
- Payment terms will be specified in your individual agreement or SOW.
- All fees are non-refundable unless otherwise specified in your written agreement.
5. Intellectual Property
- Our IP: All content, designs, code, tools, methodologies, and materials on this website and used in our services remain the exclusive property of Excalibur AI. You may not copy, modify, distribute, sell, or lease any part of our services or included materials.
- Your IP: Upon full payment, you receive ownership of the custom website and deliverables specifically created for your project. Excalibur AI retains the right to use anonymized case studies and general methodologies.
- Third-Party Materials: Our services may include third-party tools, libraries, or platforms. Your use of these is subject to their respective terms and licenses.
6. Client Responsibilities
- Provide accurate and complete information necessary for project delivery.
- Respond to requests for feedback, approvals, and content within reasonable timeframes.
- Ensure you have the rights to any content, images, or materials you provide to us.
- Maintain the security of any login credentials or accounts we set up on your behalf.
- Use our services in compliance with all applicable laws and regulations.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- Excalibur AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services.
- Our total liability for any claims arising from or related to our services shall not exceed the total fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
- We do not guarantee specific business outcomes, revenue increases, or performance metrics as a result of our services.
8. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
9. Indemnification
You agree to indemnify, defend, and hold harmless Excalibur AI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
- Either party may terminate a service agreement in accordance with the terms specified in the applicable SOW or written agreement.
- We reserve the right to suspend or terminate your access to our website at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
- Upon termination, all outstanding fees become immediately due, and provisions of these Terms that by their nature should survive termination shall survive.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Travis County, Texas.
12. Changes to These Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on this page with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms, together with any applicable SOW, privacy policy, and any other legal notices published by us on this website, constitute the entire agreement between you and Excalibur AI regarding the use of our website and services.
